If there is a minor (under age of 18) who is a green card holder due to the parent and the parent(who is also a green card holder)decides to go back to his/her native country, then what will happen to the minor's green card status if they were to stay in the United States?

    Question #107245. Asked by dj168. (Jul 20 09 4:16 PM)

I don't think anything happens to the minor's resident status.

Based on my American citizenship and residence, my husband and minor daughters received green cards--United States Permanent Resident Cards--in 1987. Had he left, my understanding is that the girls could have legally stayed with me. (Glad I never had reason to find out!)

This kind of question is better answered by an immigration lawyer. The law is complex and, frankly, the old INS (and I assume the new BCIS) was not very helpful. After we'd worked through the procedure, a friendly officer said there is so much fraud they can't afford to be nice...until they've figured out you're legit.
