It concerned a song "Muskrat Ramble"-a dixieland jazz classic from 1926.Ms Ory owned the copyright of this as it was written by her father(Edward"Kid"Ory" and Ray Gilbert)both deceased at the time of the legal hearing (August 2005)
The allegation was that Country Joe McDonald plaigiarized this song in his "I feel like I'm fixing to die rag" best known for its lyric "And its one-two-three,what are fighting for?".
When Country Joe McDonald re-released it in 1999 Ms Ory's father copywrited "Muskrat Ramble"and sued Country Joe McDonald in 2003 and 2004.The case was lost as the judge said failure to assert legal rights in a timely manner was the same as failing to assert legal rights at all.
