    Who gets the patent when two inventors have the same idea?

    Off the top of my head, I guess whoever files for the patent first gets it :)

    One example I can think of is the patent for Neem tree and its medicinal and other uses. Neem is a tree that originated on the Indian subcontinent and it has been used for medical purposes by Indians for several centuries now, but the first and most patents for Neem are held by the USA.     The most famous case of two people filing for a patent for the same idea on the same day was the telephone - the patent was filed by Alexander Graham Bell and Elisha Grey. Famously, Grey was denied the patent rights, since Bell filed for his patent first.

    According to multiple sites, Elisha Grays Patent Lawyer DID file before Bells Attorney but Bells fee for said patent was entered into the cash ledger first, thusly making Bell the first to apply.
