    Former Norbourg Investments CEO Vincent Lacroix was recently sentenced to 12 years in prison and fined $255,000 on 51 fraud charges stemming from the siphoning of accounts. Lacroix had filed an appeal which was not upheld. On what grounds was the appeal launched?

    The appeal was based largely on a Constitutional challenge.

    Last week, Lacroix appeared before Leblond requesting Monday's scheduled sentencing be postponed, to allow him to argue for a new trial on the basis of certain articles in the Canadian Charter of Rights and Freedoms he only became aware of after being found guilty.
    On Monday, Leblond rejected Lacroix's constitutional challenge. Leblond told him then, "those articles existed before (last year's trial) and the verdict is valid. Leblond also asked Lacroix why the constitutional challenge wasn't brought up at last May's preliminary hearing or during the 49-day trial.
