Why didn't Johnny, who liked free ice cream, register for the draft, and why couldn't he be punished for not doing so?

Johnny Klomberg was a ficticious friend of Eric and Greg Henzel. An ice cream store, Ferrell's, was having a promotion that allowed for the claiming of some free sudaes for members of their birthday club. The boys registered their friend so they could take advantage of the promotion.
Seven years later Johnny Klomberg receives a notification that he needs to register for the draft. The Selective Service had purchased the old mailing list of the ice cream company in order to track down individuals who fail to register for the draft.
It was discovered that Ferrell's had never granted permission for a list broker to sell their list to the Selective Service, so the government was not able to justify the notice to Johnny, As a result even if he had been real he could not have been prosecuted for failing to register for the draft.

Yay! And a warning - be careful who has your data.... And if you find yourself on a list, get off it unless you really want to be there. (Baloo has just threatened an emailer with reporting for spam, received an apology from them, and identified by other means the originator of the list they used. Baloo is about to get in touch with the supplier of the list. Baloo doesn't like unsolicited emails from businesses even if they are legit...)
