Answer: Santiago had witnessed Dawson's fenceline shooting.

This point is made several times, including: once when Lt. Cmdr. Galloway (Demi Moore) meets with Captain West, and again when Lt. Kaffee (Tom Cruise) first meets with Dawson and Downey in the brig. At trial, the fenceline shooting is the central point made during the prosecution's examination of N.I.S. agent McGuire.

Captain West tells Galloway she's "much too valuable in her present assignment to be wasted on what I'm sure will boil down to a five minute plea bargain and a week's worth of paperwork." West uses this 'excuse' after being told by his subordinates that Galloway has "been working a desk in internal affairs" after disposing of just three cases in the previous two years.

Jessup is one of those roles that it would be difficult to think of anybody other than Jack Nicholson playing. I can 'hear' the colonel using any of these lines, but he said "flash a badge".

Dawson stands his ground. "I won't dishonor myself, my unit or the Corps, so that I can go home in six months, sir." Looks like Kaffee won't get that set of steak knives for pleading out his 45th case.

Stone is referred to at least three times as "Commander Stone", and that rank and title are exclusive to the Navy (of these choices). His blue uniform and gold insignia clearly identify him as a Naval officer, as are Kaffee, Weinberg and Galloway. The US Navy has maintained a base at Guantanamo Bay (with ground support from Marines) since 1898.

It was Dawson who gave Kaffee the "failure to bathe" answer in an earlier scene when describing the typical or "garden variety Code Red". On the witness stand, Barnes lists the other three and tells of his own personal experience when was disciplined for dropping his weapon during assault drills.
