Answer: Sending him out of the airlock

Jammer originally signed up for the New Caprica Police in order to help people, which Tigh is not impressed by. He pleads for his life, telling Tyrol that he helped save Cally's life when she was supposed to be up against a firing squad. However, because others were killed under his command, including Charlie Connor's son, he is still sentenced to death for his actions by being sent out of the airlock of a Viper tube.

Answer: Tom Zarek

Although President Zarek authorized The Circle during his short time in the office, he was never actually part of the group. Tigh, Seelix, and Tyrol were accompanied by Anders, Barolay, and Charlie Connor. As is seen later in the episode, The Circle requires six members to operate, because when Anders quits they require a new member and recruit Starbuck to create a quorum.

Just after the three leaders of the fleet agree that there will be no hard feelings between them and Baltar, Six walks into the room and calls them fools for forgetting what he has done. Adama even appears to respond to something Six says, which shocks Baltar. Shortly before Roslin leans in to kiss him, Baltar realizes he is dreaming and in fact not aboard Colonial One.

As soon as their lips touch, he wakes up on a Base Star.

Zarek does not waste a moment in telling Roslin that he will nominate her as Vice President and will resign immediately, allowing her to become President once again. Admiral Adama made it clear to him that the military would not support his new presidency, so he really had no choice. In exchange for this quick transition, Roslin agrees to name him Vice President.

After The Circle convicts an unknown woman of being a collaborator, they move on to their next case, which is Felix Gaeta, known for working as President Baltar's Chief of Staff.

Anders is quick to point out that there is no hard evidence against Gaeta. Tigh tries to convince Tyrol to vote guilty by pointing out a death list with Cally's and Gaeta's name on it, but Anders argues that there is no way to know what he did after seeing the list.

After showing his uneasiness with being part of the group following Jammer's execution, Anders finally quits, saying "The war is over for me."

As we would expect, it is the model closest to Baltar, the Sixes, that are undecided on his fate. D'Anna tells Baltar that retrieving Sharon's baby on New Caprica did weigh in his favor for staying aboard the fleet, but it was not the deciding factor. Since all Cylon decisions are made by voting, there must be a majority decision among all seven models, so he must convince the Sixes that he should remain alive.

Starbuck has her qualms about joining the group, but once she sees that it was sanctioned by the President, she decides to join The Circle. Tyrol eventually gives in and votes guilty, but does so very reluctantly.

Gaeta seems resigned to his fate, after no one in the mess hall believes that he actually worked for the Resistance. He offers nothing in his own defense despite Tyrol wanting a reason to let him off. Gaeta says he won't beg for his life, but Starbuck demands that he does and goes over his story of passing information to the Resistance, including the dog bowl he used to signal information had been put in a dead drop to pass to Chief Tyrol. With that, Tyrol takes off his restraints and lets Gaeta go free.

At the end of the episode, Tyrol sits with Gaeta in the mess hall among those who originally shunned him when Starbuck was talking to him earlier.

Answer: She issues a general pardon to everyone for their actions on New Caprica

The newly-reinstated President Roslin announces that she intended on forming a "special prosecutor's office charged with investigating acts of collaborating with the enemy," but instead issues a general pardon to every human being in the fleet. She instead starts a commission on "truth and reconciliation" to record their story for posterity.

The move thereby pardons everyone except Gaius Baltar, who is no longer in the fleet.
