1. Did Toby apply for a pardon?

Answer: No

When CJ found out that Toby hadn't applied for a pardon, she thought it was so the President didn't have to make the choice whether or not to choose him.
2. When the President-Elect offered CJ a position in his administration due to her institutional memory, how long did he say he would need her?

Answer: Two years

CJ told Danny she thought she would have to take the President-Elect's offer just because he was the President and he asked her to hold the position of special counsel.

Andy wanted CJ to talk to the President about it, but CJ went to Toby first and asked him if wanted a pardon. Toby told her he didn't want a pardon, but thanked her for asking him. He told her he had to leave on the twenty-sixth of January for the prison at Petersburg which was low security and had ten bunks to a room.

After visiting Toby, CJ went to Danny's apartment and they talked. Danny asked her if she wanted to take the President-Elect's offer and CJ shook her head no which left her with the position that Frank Hollis gave her which was to take ten billion dollars and construct highways in Africa.
