A man who is in the middle of a divorce is demanding the return of the kidney that he donated to his wife, or $1.5 million in compensation.

This is in New York. He donated the kidney to his wife in 2001 and she filed for divorce in 2005.

Sorry. The deal has already been completed and he is out of luck. It has been 8 years. The statute of limitations has run (if it would even apply). It is illegal to charge for organs in a transplant. He says she cheated, yet she is the one who filed for divorce.

Sounds like a case of "poor me". His attorney, Dominic Barbara, is an attention seeker and I believe is wasting the time of the court as well as his own time.

Thanks for putting the topic up, Sue. Do we get to read your perspective about the whole thing? I hope so.

I was wondering if she was to give back the kidney and then take ill..could she take him to court for attempted murder?

I wonder how he would feel if he took it back and she died. Besides since you can't (legally) pay for a kidney it would be like taking back a gift he had given her. Sounds like revenge to me.

I think, by his comments, he would not care if she did die.

He is angry and rather than deal with this divorce, and any other issues, in private, he decided to take it to a public forum.

I suspect he wants to be right and that is all he cares about.

Divorce is rarely *calm and pretty*, but this is about as low as you can get, period. I'm appalled by the fact this would even be up for consideration in a court of law.

I think I have a perfect "solution" to this guy's snort. OK. Considering that he's taken the [entirely bizarre] notion of considering internal organs (no matter where they came from) the sort of things that couples splitting have to divvy up and share? Let's liken this kidney to one of their children, then. Or the family pet. Etcetera, etcetera. Seeing as how one can't cut children, dogs or, in this case, organs literally in half, shared custody seems the most sensible route. If this dude "loves" his ex-kidney so much? Problem solved. Force him to have joint custody of it, meaning he gets to 'look after it' every other weekend per month. Which, of course, also means that he'd have to spend those weekends with the vessel of said kidney.

I'm pretty sure he'd drop the lawsuit in a hurry ...

It would be as much use to him. IF she were to give him back the kidney it would be destroyed as it couldn't be put back inside him.

So who would pay for her surgery and the resulting dialysis then possible new transplant should another kidney become available?

Apart from anything else no reputable surgeon would remove the kidney from her if it is functioning, not a chance.

Sheesh, and this man is a doctor himself.
