The State of California accepts the current 50 star flag as the official Flag of the United States so it is of course the one proscribed to be flown within the state. However, Government Code Section 438 allows any US flag purchased before March 18, 1959 to be used. The 49 star flag was official on July 4, 1959 and the 50 star (current) flag was official on July 4, 1960. This probably resulted from the state not wanting to have to buy flags after Alaska's admission into the US considering that they would have to buy new ones very soon when Hawaii was admitted. But the statute is still on the books so legally a state, county, city, or district agency could use a 48 (or earlier) star flag if it purchased the flag a long time ago.
