Subject: Info about Label Quiz images

I asked our always-helpful WesleyCrusher for his input on a question I had regarding images used in Label Quizzes. Not only did he give me the OK to share his response, but in fact he encouraged me to share it (here in the Author Lounge), if I thought it'd be useful for others -- and I believe I've seen this come up every so often.

For context, I had asked basically this: "I'm writing a Label Quiz, and the image-upload page wants me to choose whether my image is 'my own work,' 'public domain,' etc. It's a public-domain image, but I've made changes / additions to fit the Label format -- e.g., adding numbers and a pointer arrow -- and I'm not sure if that kind of thing rises to the level of a 'derivative work.'" (I referred to his quiz "Can I use this image in my photo quiz?", which discusses this somewhat.)

He replied: "The clear choice here is public domain. You're not adding anything to the map itself, you are just providing the needed data to play the quiz. In this case, you don't even need to add any comment to indicate you did processing - think of the numbers as a separate overlay. For a derivative work to be 'my own' with quoted sources, you need to make very significant changes - enough that the result is clearly no longer the original(s). If I were to merely take a picture of a cat from the web, cropped it and color the eyes blue instead of yellow, it would still be the original license, with 'cropped and eyes recolored' added to the credit. (The reason we ask for this processing info is that we want to be able to compare to the original in case of any rights inquiry.)"

I explained that the "View Image Attributions" button doesn't exist in Label Quizzes (at least presently), so I'd rather ask for clarification instead of just guess.

So that's more or less the twofold bottom-line:
(1) When making a Label Quiz, if you're simply adding to an image the elements needed for the Label format, choose whatever usage option the original one was (e.g., public domain; Creative Commons - Attribution Only).
(2) As always, never hesitate to ask editor -- per Wes again, "Asking is the best thing you can do - we're here mostly to answer and make your experience a good one." Even if it feels like the question is silly or the answer obvious, you'll always get a friendly and helping hand.
