Answer: Motor Vehicle Division

Well it was mainly Jimmy who hired Francesca; Kim wanted to interview more candidates, but Jimmy jumped the gun and asked Francesca if she could start right away. He had a commercial airing shortly and needed someone to help with the phones. Kim also would have preferred to interview candidates with legal experience. Francesca had seven years experience at the MVD; she said that she learned patience and diplomacy there, but she didn't like the bureaucracy and wanted to work somewhere where she "could make a difference". Francesca was also able to explain why it was called the Motor Vehicle Division as opposed to the Department of Motor Vehicles: "Just like in Arizona, the Motor Vehicles Division is part of the DOT, a division, whereas in most other states, the DMV....is its own entity".

Mike watched him walk into the restaurant with a large backpack and later leave with it, but the gas cap tracker stayed at the restaurant. Mike wanted to know what the man did inside the restaurant, but he obviously couldn't go in since he was the target of their tracker, so he asked Jimmy to do so. Jimmy lacked Mike's subtle skills: He spilled soda, poured too much sugar into his coffee, changed seats to get a better view and then stared incessantly at the target.

Despite Jimmy's conscientious observance of the man with the knapsack, he hadn't noticed anything out of the ordinary, so when the man bused his tray and left, Jimmy thought that he might have tossed something in the trash. Continuing with his inconspicuous mission, Jimmy stuck his head into the bin and searched around to see if there was anything of interest.

He was interrupted when Gus Fring asked him, "Can I help you?" At least Jimmy thinks fast on his feet - he knocked his watch off while in the bin and then told Fring that it had fallen off when he was clearing his tray. Fring put on gloves and found the watch for Jimmy, but the cold stare as Jimmy drove away told us that he didn't buy the story.

While Chuck had made it seem that Ernesto had heard the tape by accident, we found out that it was part of Chuck's plan to entrap Jimmy. Despite his speech to Ernesto about confidentiality, he expected Ernesto to tell Jimmy about the tape. But Ernesto didn't do so - he was "a little hazy on the legal points" but thought that if he told Kim instead of Jimmy, he would "have a buffer".

He didn't want to get in trouble but he wanted to help Jimmy.

After Jimmy left following his surveillance attempt at Los Pollos Hermanos, Mike continued to watch the restaurant, marking down the details of every vehicle that came and went. He finally noticed a big black SUV speed into the parking lot and park around back.

When it left a short time later, he saw on his monitor that the tracking device was moving, so he followed the SUV. He tracked the device to a barren area in the middle of nowhere and found his gas cap in the middle of the road with a ringing cell phone on it.

He answered the phone with a monotone "yeah".

The impeccably-dressed Howard parked his car on the next block away from Chuck's house and proceeded to climb over several walls to get to Chuck's backyard, taking time to straighten his tie and suit after each wall. When he reached Chuck's back door, Chuck asked him to put his electronics in a planter - "You have to hide them". Howard looked frustrated but as usual, he complied with Chuck's requests.

Chuck knew that he wouldn't be able to successfully use the tape in court, but he had another idea; he wanted to catch Jimmy in the act of a felony when Jimmy tried to obtain the tape. For eight days, the law firm had paid for surveillance at Chuck's place around-the-clock, and Howard was losing his patience over the cost so he came to see Chuck to convince him to give up his plan. Chuck agreed to reduce the surveillance to "just night time hours" since "Jimmy will most likely break in while he thinks I am sleeping". Chuck expected Jimmy "to steal the tape under cover of darkness". Howard seemed incredulous, but right after Chuck said, "I know my brother", we heard Jimmy banging on the door.

Jimmy looked horribly hurt when Kim told him about the recording: "He taped me?" Kim suspected that Chuck couldn't use the tape but that Chuck must have made it for a particular purpose. Unfortunately she didn't guess that it was to goad Jimmy into trying to get the tape.

She told Jimmy that they needed to "wait for his move and then act accordingly". After Jimmy was done seeing customers, he returned to working on the logo on the wall. He was rolling off the tape with the same technique that Chuck had taught him, but he became angry and yanked the tape off, messing up the perfect lines.

He then headed to Chuck's house and kicked in the door when Chuck told him to go away.

Executive Producer/writer Thomas Schnauz stated that the title referred to two scenes: Jimmy was a witness for Mike at Los Pollos Hermanos and Howard was a witness for Chuck against Jimmy, but Howard just happened to be there at the right time. When he arrived at Chuck's home, Chuck asked him why he was there - he clearly wasn't expected.

Instead, Chuck had private investigators staying at his home around-the-clock to act as his witness when Jimmy came for the tape. When Jimmy arrived, he finally let his brother verbally have it: "You TAPED me?! You pulled that heart strings con job on me?" He broke into Chuck's locked drawer and pulled the tape out: "For this you destroyed our family? You happy now? For what? For nothing!" He broke the tape apart and threatened to burn down the house if Chuck didn't tell him whether there were copies of the tape. Howard and the investigator ran in at that moment, and Chuck calmly asked Howard if he was "a witness to what happened here".

The investigator also said, "I'm a witness" as Jimmy and Chuck stared each other down.
